The Planning Committee on January 5, 1998 recommended that the Discipline Section of the State Rules be included in Chapter IV. SERVICE DELIVERY rather than making Discipline a separate chapter.

2. Section 300.121 - FAPE and Suspension & Expulsion

Use of term "suspension"

In Response to OSEP we said:

The term "out of school suspension" means "no service". The draft regulations in §300.520(a)(1) added the phrase "including a suspension without the provision of educational services" to the statute language (§615(k)(1)(A)(i)). We believe that this phrase should be removed because it implies that there are two types of suspension: one with services and one without services. Consistently use the term, "out of school suspension" through out the document.

    Do we want to recommend combining Manifestation Determination & Functional Behavioral Assessment

    Monitoring: We need to develop recommendations for how Discipline provisions are monitored. Assurance statements, checklist items, interview questions. Go through each section and discuss this issue. Include any necessary explanations.
