P.L. 105-17 Draft regulations

1. Term Emotional/Behavioral Disorder (E/BD)-- The task force agreed with the Evaluation and Eligibility task force about keeping the definition the same as the current definition. Some members of the task force have concerns regarding adding the word "emotional" to the definition.
2. Documenting the Manifestation Determination Review-The task force discussed the issue of what documentation is required: (1) If the behavior IS a manifestation of the child's disability, and (2) If the behavior IS NOT a manifestation of the child's disability. We agreed that if the behavior IS a manifestation of the child's disability, less documentation is required than if it IS NOT. We also agreed that this issue should be addressed in the User's Guide rather than the State Rules.
3. Editing the Draft Regulations-The task force spent the remainder of the time editing the discipline sections of the Draft Regulations. Please see the attached copies.
