- Response to OSEP regarding the Draft Federal Regulations
--The Planning Committee responded to and edited the response to OSEP. Please refer to the completed documented.
- Changes to Utah Statue
--We will not recommend any changes during this session of the legislature.
- Task Force Reports
--Please refer to the reports provided by each Task Force. Key points in regard to the Utah Rules which were discussed by the Planning Committee are presented as follows.
- Developmental Disability
--Much discussion ensued during which time our new preschool specialist recommended using the ages 3-7. The vote was three through seven. Please see §300.7 Note #2 on page 55070 for information about how this requirement is to be implemented. At this point, if Utah adopts the age range 3 through 7, school districts will have the choice to identify children within that age range as developmentally delayed or as one of the other categories.
- Emotionally Disturbed
--The Evaluation and Eligibility (E&E)Task Force recommended use of the term "emotional/behavior disorder". There appears to be much debate regarding this term. The decision was to accept the Task Force recommendation. The Task Force is continuing to have some discussion regarding this issue and there may be additional information forthcoming.
- Autism
--The E&E Task Force recommendation that Note 1 in §300.7(b)(1) page 55070 be added immediately following the section was accepted.
- Mental Retardation
-- The E&E Task Force recommendation that Utah adopt the term "Intellectual Disability" and that the current description in the Utah SBE/SER be continued under this category was accepted.
- Other Health Impairment
-- The E&E Task Force recommendation that Note 5 be expanded to include other health conditions was accepted.
- Traumatic Brain Injury
--Please refer to §300.7(b)(12) on page 55070. The concept of "external force" was added to the federal regulations. The Planning Committee recommended modifying the Utah Rules accordingly.
- Other Eligibility Categories
--Other definitions listed in the SBE/SER will be maintained as currently stated.
- State Assessment and Performance Goals Task Force
--Discussion was held regarding the recommendations of this task force. Please refer to their report for specific details. The decision made by the Planning Committee was that we develop goals for performance for children in Utah with out reference to any specific population of students i.e., preschool students or students with severe disabilities.
