OSEP Visit
Chuck's comments:
OSEP's ultimate goal this week is to complete the inventory of the new requirements
They also want to help people come to consensus of what the IDEA 97 implementation plan will look like
Chuck described several of the themes in P.L. 105-17
Sheila comments:
- OSEP will provide answers to the questions that were submitted by the task forces.
- Draft Regulations may be out tomorrow
PLANNING COMMITTEE DISCUSSION ITEMS
- We want the new rules to go to the Board by April.
- Steve talked about the State Improvement Grant and the retreat that he attended. States need to work on their strategic plans first. The Utah Agenda seems like an obvious place for Utah to start. The RFP is coming forward very soon. 20 states will get money in the first year.
- SEA Requirements split into 4 task forces, no longer an SEA task force
- Monitoring
- State Improvement Grant & CSPD
- State Assessments & Performance Goals and Indicators
- Interagency Agreements
- Statewide Assessment
- will be the most difficult part of the law to implement not Discipline.
- Steve attended the NASDE-Wingspread Retreat where they talked about Statewide Assessment. Need to make sure we have alignment between goals, curriculum, instruction, and accommodations.
Model states include New York and Virginia
New York's core is very general (50 skills)
Utah's is more detailed.
- Utah is now a member of National Chief School Officers Committee-We will have access to some of the best resources (in St. Louis).
- Donna attended a national meeting on alternate assessments. We have until the year 2000 to get this done.
- Interagency Agreements
-Preschool agreement is the first one to work with.
State IDEA 97 Implementation Plan---
- We need to have public input for the implementation plan. We think the Planning Committee. is a good way to get public input. We will put the plan on the web. The time frame is under 1 month.
- Utah does not have an open federal CAP report.
- The next planning meeting November 13th is in Park City. We need to respond to the draft implementation plan by November 31st
- We can amend the plan as we go along but it is important to provide feedback to OSEP on a regular basis to keep them updated.
- We will build in a way to comment on the implementation plan on the web. We will put Mae's email address on the web.
- USOE will put the Implementation Plan together.
District IDEA 97 Implementation Plans-
- Open CAPs will be added to district implementation plans. LEAD needs to talk about district implementation plans.
Monitoring
- Nothing mandates the way monitoring is to be done. Some states are doing targeted monitoring for example.
Planning Committee members should bring back input at the next meeting.
Task Force Reports
Evaluation & Eligibility-haven't reached any conclusions at this point.
Placement-Linda Smith read the purpose statement
- Involvement of parent-districts must document parent involvement from the beginning of the process
Funding--Ben Bruse gave a brief report of the Funding Task Force Activities
- The preschool formula will be considered tomorrow.
Procedural Safeguards--Helen Post gave a brief report
Prior notice requirements can be addressed by putting the required elements on another document such as the IEP.
- Sheila indicated that a complaint-means due process hearing
- The State Investigation complaint process is not in the statute
- How parents have to file a complaint will require a lot of training.
- Mediation change was discussed
IEP Task Force-Randy and Ronda
Randy and Ronda read the purpose statements for Present Levels of Educational Performance and Annual Goals.
A discussion was held in regard to the term "general curriculum" and especially as it relates to preschool.
Discipline Task Force
We are prepared to respond to the draft regulations and hope that they will be directly in line with the OSEP Guidance Letter of September 19, 1997.
Cal just attended a NASDE, OSEP, CEC forum on defining an Interim Alternative Educational Setting (IAES)
He reported that there is no data on IAES-- the closest research is on home study. Also there is no data on 45-day treatment plans.
Home and hospital services should not be used for kids in custody or discipline. The discipline task force needs to discuss this issue.
Currently, home instruction is used as a IAES intervention 98% of the time.
Cal reported on a program called "STOP" used in the Des Moines Public Schools that has a heavy emphasis on technology, social skills, and vocational education.
A discussion on Manifestation Determination Reviews was held. There are different opinions on how the reviews should be handled.
Steve said that some states are considering implementing the discipline procedures with all treats as kids. There is a proposal before congress right now in the elementary and secondary act.
General procedures for the task forces
Steve Hirase suggested that we have one overall purpose statement for each Task Force. This suggestion was accepted by the group.
Glossary terms-Task Forcess need to define the terms in order to get everyone on the same page. Do it if you need to.
Task Forces will develop recommendation for state rules. They should develop these recommendations first and then come back and add the rest of the components of the model.
Action Steps:
Re-print model with rules as a separate item on the model and get it to everyone on the Planning Committee.
